Debt Consolidation Class Action Lawsuit
Debt consolidation company US Credit Management, Inc. is in the
business of "debt elimination and credit counseling." A
Rasansky Law Firm Client who is a customer of US Credit Management,
Inc. has filed a class action lawsuit against
US Credit Management, Inc. alleging that it is operating in violation
of Federal law and that it is operating a deby-pooling business
in violation of Texas law.
US Credit Management Lawsuit Update
On September 1, 2005 the court denied US Credit Management’s
request that the lawsuit be dismissed and sent to arbitration.
The court found that the Client Services Agreement that was signed
by all USCM customers is void and unenforceable. Therefore, the
Plaintiffs will be allowed to proceed with the case in court.
Now we will begin the process of formally gathering information
from USCM (this process is known as “discovery”) to
support a request that the court certify this case as a class action.
This process will probably take several more months.
Other than the 3 named plaintiffs in the lawsuit, other USCM clients
are not a part of this suit and cannot join or otherwise become
a part of this suit unless the court certifies the case as a class
action.

The Rasansky Law Firm Client has made the following allegations
in her class action lawsuit:
Soliciting People with Unsecured Debt
US Credit Management, Inc. solicits consumers who have incurred
substantial amounts of unsecured debt and claims it will help them
become debt free.
Consumer Required to Provide Total Indebtedness
After entering into a contract for services with US Credit Management,
Inc., the consumer is required to provide the consumer's total
indebtedness, and the identities of the consumer's unsecured creditors,
including the specific amount of money owed to each creditor.
Fixed Sum Payments
Based on the information provided by the consumer, US Credit Management,
Inc. determines a fixed sum to be paid by the consumer to US. Credit
Management, Inc. on a monthly basis.
Debt Reduction
US Credit Management, Inc. ultimately attempts to negotiate a
reduction in the consumer's debt and then distributes the reduced
amounts creditors.
Credit Repair Disclosures
The Rasansky Law Firm Client has alleged that US. Credit Management,
Inc. does not make various disclosures required by the Federal
Credit Repair Organizations Act and that its operations violate
numerous provisions of the Texas
Finance Code and are deceptive trade practices.
