Gastric Bypass Malpractice Lawsuits are on the Rise
Gastric Bypass Malpractice and resulting lawsuits are on the rise.
Gastric bypass statistics show that over 90,000 people will have
gastric bypass surgery to treat obesity. One in two hundred gastric
bypass patients will die from the surgery. This is a death rate
double that of other major surgeries with similar complexity.
What is gastric bypass surgery?
Gastric bypass surgery involves the reduction of the stomach pouch
to a pouch about one ounce or less in size, and the creation of
a stoma, or a small opening between the intestine and the
stomach. The stomach pouch is reduced in size, and therefore achieves
a quicker sensation of fullness after eating. With a gastric bypass,
you become full quicker due to the smaller size of your stomach.
Also, the stoma delays the emptying of the
stomach, allowing you to stay "full" longer.
Although gastric bypass surgery might sound simple and not as
invasive as other major surgeries, the operation still
involves cutting and reconnection of stomach tissues in which problems
can arise. Gastric bypass surgery can be a life threatening proceedure,
and malpractice is occurring all too often as doctors and medical
facilities are failing to properly assess the early signs of trouble.
Complications of Gastric Bypass Surgery
Complications of gastric bypass surgery include: negligence causing
leakage of gastrointestinal juices from the sutures or staple lines,
which often results in serious personal injury such as infection,
abscess, peritonitis and sometimes wrongful death.
Other complications that can occur during a gastric bypass procedure
include pulmonary emboli (blood clot in the lungs) and respiratory
failure resulting in death. Post operative gastric bypass complications
can include kidney problems, gallstones, hernia, and small bowel
obstruction.
Pain from gastric bypass surgery should subside significantly
by the second day after surgery. If back pain, shoulder
pain, excessive urination, and difficulty breathing occurs, a gastrointestinal
leakage could be suspected. These symptoms of gastric bypass complications
should not be overlooked.
At the Rasansky Law Firm, our team of gastric bypass lawyers
will look at several common signs of gastric bypass malpractice,
including the failure to assess gastrointestinal leakages properly,
in determining if Gastric Bypass Malpractice and Negligence could
have caused your loved one’s painful suffering, catastrophic
injury, or wrongful death.
Signs of Gastric Bypass Surgery Medical Malpractice
- Inexperienced doctors, some performing surgery after only taking
a weekend seminar.
- Surgery occurred in a facility lacking appropriately sized
equipment such as diagnostic tools, instruments, and operating
tables for an obese person.
- Excessive pain after a Gastric Bypass Surgery
- Serious complications occur such as clotting, kidney problems,
and respiratory problems
- Doctors failed to respond in an efficient manner when a patient
complained of symptoms indicating gastrointestinal leakage
or other complications resulting in death.
- Physicians performing too many surgeries in a day, resulting
in fatigue and essentially putting patients at risk.
- Failure to educate the patient and their family of all the
risks associated with a Gastric Bypass surgery and failing to
educate them on post operation surgery.
